Welcome to Flat Haito ("we", "our", "us", or "the Platform"). These Terms & Conditions ("Terms") govern your access to and use of the Flat Haito mobile application (available on Android) and website at flathaito.com (collectively, the "Services").
Please read these Terms carefully before using our Services. By downloading the Flat Haito app, creating an account, or browsing our website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the Flat Haito Services. These Terms constitute a legally binding agreement between you and Flat Haito.
1. Acceptance of Terms
By accessing or using Flat Haito in any manner, including visiting the website, downloading the app, creating an account, or browsing listings, you agree to be bound by these Terms. This agreement is effective as of the date you first access the Services.
You must be at least 18 years of age to use Flat Haito. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.
These Terms apply to all users of the platform, including tenants looking for rental properties and property owners listing their properties.
2. About the Platform
Flat Haito is a property rental listing platform operating primarily in Madhya Pradesh, India — currently serving Indore, Dewas, Ujjain, and Bhopal. Our tagline is "Ghar Jesa" (Feels Like Home).
Flat Haito acts as a platform intermediary that connects property owners directly with prospective tenants. We do not own, manage, or control the properties listed on our platform. We are not a real estate broker, agent, or dealer.
- Flat Haito does not take brokerage fees from tenants for finding properties.
- Flat Haito verifies listings through our team before they go live, but verification does not constitute a guarantee or warranty of any property's condition, legal status, or availability.
- All rental agreements are made directly between the property owner and the tenant. Flat Haito is not a party to any such agreement.
3. User Accounts & Registration
To use most features of Flat Haito, you must create an account. Registration is done exclusively via OTP-based phone authentication using your Indian mobile number (+91). No passwords are created or stored.
Account Creation
- You must provide a valid Indian mobile number that you own and control.
- First-time users must complete a profile setup with at least their full name.
- You are responsible for keeping your phone number accessible for OTP verification.
- Each mobile number may only be associated with one Flat Haito account.
Account Security
- You are responsible for all activity that occurs under your account.
- You must not share your OTP or session with any other person.
- If you suspect unauthorised access to your account, contact us immediately at support@flathaito.com.
Account Accuracy
- You agree to provide accurate, current, and complete information at registration and to keep it updated.
- Providing false information may result in immediate account suspension or termination.
4. User Roles
Flat Haito has two distinct user roles. You select your role during the onboarding flow:
Tenant
A tenant is a user who uses the platform to search for, save, and schedule visits to rental properties. Tenants can browse verified listings, filter by location and BHK type, add properties to a wishlist, and book site visits — all for free.
Owner (Property Owner)
An owner is a user who lists one or more rental properties on the platform to find tenants. Owners can create and manage property listings including photos, amenities, rent details, and unit configurations.
You may not use a tenant account to list properties or an owner account to misrepresent your identity. Misuse of roles is grounds for account termination.
5. Owner Responsibilities
As a property owner on Flat Haito, you agree to the following:
Accuracy of Listings
- All information you provide about a property (address, rent, photos, amenities, availability) must be accurate, truthful, and up to date.
- Photos must be actual photos of the property being listed. Stock images or misleading photos are strictly prohibited.
- You must not list a property that you do not own, manage, or have authority to rent.
- You must promptly remove or update a listing when a property is no longer available for rent.
Compliance
- You are solely responsible for complying with all applicable laws regarding property rental in India, including tenancy laws of Madhya Pradesh.
- You are responsible for obtaining all necessary permissions, licences, and no-objection certificates (NOCs) required to rent your property.
- Flat Haito's verification process does not substitute for legal compliance on your part.
Conduct with Tenants
- You agree to respond to tenant enquiries and visit requests in a timely and professional manner.
- You must not discriminate against tenants on the basis of religion, caste, gender, national origin, or any other protected characteristic under Indian law.
- All rental terms, conditions, and agreements must be finalised directly with the tenant and must comply with applicable law.
6. Tenant Responsibilities
As a tenant using Flat Haito, you agree to the following:
Genuine Intent
- You will only browse listings and schedule visits if you have a genuine interest in renting a property.
- You will not spam owners with fake enquiries or visit bookings.
Visit Etiquette
- If you book a property visit, you agree to arrive at the scheduled time or to cancel the visit in advance via the app.
- You will treat the property and the owner with respect during any visit.
- Flat Haito is not responsible for any disputes, damages, or incidents that occur during a property visit.
Verification
- You are responsible for independently verifying any property's condition, legal status, neighbourhood, and any other factors relevant to your decision before signing a rental agreement.
- Flat Haito's listing verification does not constitute a warranty of the property's fitness for your specific needs.
7. Prohibited Activities
You agree not to engage in any of the following activities while using Flat Haito:
Fraudulent or Illegal Conduct
- Listing properties that you do not own or have no authority to rent.
- Providing false, misleading, or fraudulent information in your profile or listings.
- Impersonating any person, including property owners, Flat Haito staff, or other users.
- Engaging in any activity that violates Indian law, including the Indian Penal Code, Information Technology Act, or Consumer Protection Act.
Platform Misuse
- Attempting to scrape, crawl, or systematically download content from the platform.
- Using bots, automated scripts, or other automated means to access the Services.
- Circumventing any technical measures we use to protect the platform.
- Creating multiple accounts to evade a ban or restriction.
- Attempting to reverse-engineer the app or access our backend systems without authorisation.
Harmful Content
- Uploading or sharing any content that is obscene, defamatory, harassing, threatening, or harmful.
- Uploading malware, viruses, or any other malicious code.
- Using the platform to solicit or distribute spam, chain letters, or unsolicited commercial messages.
Brokerage Circumvention
- Charging tenants any brokerage, finder's fee, or commission in connection with a listing on Flat Haito. The platform is expressly broker-free for tenants.
Violation of any of the above may result in immediate account suspension, permanent ban, and where applicable, legal action under Indian law.
8. Property Listings & Content
Owner-Submitted Content
By submitting a property listing (including photos, descriptions, and details), you grant Flat Haito a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the platform for the purpose of providing the Services.
You retain ownership of all content you submit. Flat Haito does not claim ownership of your listings or photos.
Verification & Moderation
- All listings are reviewed by the Flat Haito team before publication. We reserve the right to reject, edit, or remove any listing that violates these Terms or our content standards.
- Verification by our team confirms basic listing details but does not constitute a legal endorsement, valuation, or guarantee of the property.
Listing Removal
- Flat Haito reserves the right to remove any listing at any time without prior notice if it is found to violate these Terms, contain inaccurate information, or for any other operational reason.
- Owners must remove listings as soon as the property is no longer available.
9. Visit Scheduling
The visit scheduling feature allows tenants to book a property visit directly through the app. The following terms apply:
- A scheduled visit is a request — it is subject to confirmation by the property owner.
- Flat Haito facilitates the scheduling tool but is not responsible for confirming, rescheduling, or cancelling visits on behalf of either party.
- Tenants and owners are solely responsible for communicating and honouring scheduled visits.
- Flat Haito is not liable for any loss, inconvenience, or damages arising from a cancelled, missed, or rescheduled visit.
- Any dispute arising from a property visit must be resolved directly between the tenant and the owner. Flat Haito may, at its sole discretion, assist in mediation but is under no obligation to do so.
10. Zero Brokerage Policy
Flat Haito is committed to a zero brokerage model for tenants. This means:
- Tenants are never charged a brokerage, commission, or finder's fee by Flat Haito for using the platform or for finding a property through our Services.
- Tenants pay rent directly to property owners as agreed between them. Flat Haito is not involved in any financial transaction related to rent.
- Property owners may not use the Flat Haito platform to charge tenants any brokerage or commission.
While the tenant-facing service is free, Flat Haito may in the future offer premium features or subscription plans to property owners (e.g., boosted listings, analytics). These will always be clearly disclosed. See Section 11 for details.
11. Payments & Subscriptions
Currently, the core features of Flat Haito are free for both tenants and owners. In the future, we may introduce optional paid subscription plans for property owners. The following terms apply:
- Any paid features will be clearly labelled and require your explicit opt-in.
- Subscription fees, if any, will be charged in Indian Rupees (INR) and will be disclosed before purchase.
- All payments are processed through secure third-party payment gateways (e.g., Stripe). Flat Haito does not store your card or payment details on our servers.
- Refunds for paid subscriptions will be governed by a refund policy that will be published at the time of launch of paid plans.
- Flat Haito is not responsible for any payment disputes with third-party payment processors.

12. Intellectual Property
All intellectual property rights in the Flat Haito app, website, logo, tagline "Ghar Jesa", design, software, and original content (excluding user-submitted listings) are owned by or licensed to Flat Haito.
- The name Flat Haito and tagline "Ghar Jesa" are trademarks of Flat Haito. You may not use them without our prior written consent.
- You may not copy, reproduce, distribute, modify, or create derivative works from any part of our platform without explicit written permission from Flat Haito.
- The Flat Haito app is proprietary software. You are granted a limited, non-exclusive, non-transferable licence to install and use the app on your personal Android device solely for personal, non-commercial purposes.
13. Disclaimer of Warranties
The Flat Haito Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by Indian law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Services will be uninterrupted, error-free, or completely secure.
- Warranties regarding the accuracy, completeness, reliability, or currentness of any property listing, owner details, or other content on the platform.
Flat Haito verifies listings before publication, but we cannot guarantee that all information provided by owners is accurate. Tenants are strongly advised to personally visit and independently verify any property before making any payment or signing any agreement.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Flat Haito, its founders, employees, and affiliates shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or other intangible losses.
- Damages arising from any transaction, agreement, or dispute between a tenant and a property owner.
- Damages arising from reliance on any property listing, description, or information on the platform.
- Damages resulting from unauthorised access to your account or data caused by your own failure to secure your OTP.
- Any loss resulting from the temporary unavailability of our Services due to maintenance, outages, or technical issues.
In no event shall Flat Haito's total liability to you for all claims exceed INR 5,000 (Five Thousand Rupees) or the amount you paid to Flat Haito in the three months preceding the claim, whichever is lower.
15. Indemnification
You agree to indemnify, defend, and hold harmless Flat Haito and its founders, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to the Services.
- Your violation of these Terms or our Privacy Policy.
- Any content you submit to the platform, including property listings and photos.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any rental transaction or dispute between you and another user of the platform.
16. Termination
Termination by You
You may stop using the Services at any time. To permanently delete your account and associated data, email support@flathaito.com with subject line "Delete My Account", or use the in-app Profile screen. We will process your request within 30 days.
Termination by Flat Haito
We reserve the right to suspend or permanently terminate your account and access to the Services at our sole discretion, immediately and without prior notice, if we believe you have:
- Violated any provision of these Terms.
- Engaged in fraudulent, abusive, or harmful conduct on the platform.
- Provided false or misleading information.
- Taken actions that could harm Flat Haito, its users, or third parties.
Effect of Termination
Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including Sections 12, 13, 14, 15, 17) shall continue in full force and effect.
17. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India.
Before initiating any legal action, both parties agree to attempt to resolve the dispute amicably by contacting Flat Haito at support@flathaito.com. We will make good-faith efforts to resolve disputes within 30 days of receiving notice.
18. Changes to Terms
Flat Haito reserves the right to update or modify these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page.
- Notify users through the app or via SMS/email for material changes.
Your continued use of the Services after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Services and may request account deletion.
We encourage you to review these Terms periodically to stay informed of your rights and obligations.
